1. Agreement to Terms

By accessing or using Linked and Inked ("the Service"), operated by Linked and Inked ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Linked and Inked is a customer relationship management tool designed for content creators to manage brand sponsorship opportunities. The Service includes brand discovery, AI-assisted pitch generation, email integration, pipeline management, rate intelligence, and related features.

3. Eligibility

You must be at least 18 years old to use the Service. If you are between 13 and 17, you may use the Service only with parental or guardian consent.

4. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized access.

5. Subscription and Billing

The Service offers a free tier and a paid "Pro" subscription. Pro is billed monthly ($10/month) or annually ($100/year) via Stripe. Subscriptions auto-renew unless cancelled. You may cancel at any time from your account settings, effective at the end of the current billing period. No refunds are provided for partial billing periods.

6. Acceptable Use

You agree not to:

• Use the Service for spam, phishing, or unsolicited bulk communications
• Violate CAN-SPAM, GDPR, or other applicable laws when sending emails
• Attempt to reverse-engineer, scrape, or overload the Service
• Share account credentials or resell access
• Upload malicious content or interfere with other users' experience
• Use AI-generated content in a misleading or deceptive manner

7. User Content

You retain ownership of all content you upload or create (pitches, brand data, notes, portfolio content). By using the Service, you grant us a limited license to store, process, and display your content solely to provide the Service to you. We will never sell your content to third parties.

8. AI-Generated Content

The Service uses artificial intelligence to generate pitch drafts, follow-up messages, and rate suggestions. AI outputs are suggestions only — you are responsible for reviewing and approving all content before sending. We do not guarantee the accuracy, appropriateness, or effectiveness of AI-generated content.

9. Crowdsourced Data

If you contribute data to crowdsourced features (rate data, brand behavior), it is anonymized and aggregated. Individual contributions are never attributable to specific users. You may opt out of contributing crowdsourced data in your account settings.

10. Intellectual Property

The Service, including its design, code, and branding, is owned by Linked and Inked. Nothing in these Terms grants you rights to our intellectual property except the limited right to use the Service as described.

11. Third-Party Services

The Service integrates with third-party services (email providers, Stripe, Google Calendar). Your use of those services is subject to their respective terms. We are not responsible for third-party service availability or policies.

12. Limitation of Liability

To the maximum extent permitted by law, Linked and Inked shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, deals, or data, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that AI suggestions will result in successful sponsorship outcomes.

14. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. You may export your data before termination. We may retain anonymized, aggregated data after account deletion.

15. Rate Data and Estimates

Rate estimates, benchmarks, and calculations provided by Linked and Inked (including the Rate Calculator) are for informational purposes only. They are derived from published industry data, algorithmic estimates, and voluntary user contributions. We do not guarantee the accuracy, completeness, or applicability of any rate data to your specific situation. Rate information does not constitute financial, legal, or professional advice. You are solely responsible for the rates you negotiate and charge.

16. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.

17. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
